In February 2024, Safe Work Australia released a report that revealed startling statistics on work-related psychological injuries across the country. It showed an increase in compensation claims related to mental health conditions, many of which were linked to prolonged absences from the workforce and difficulty returning. The data underscores an urgent reality – psychological injuries are not only affecting individual workers but also having long-term impacts on workplaces.
In this context, fair and thorough workplace investigations can achieve positive outcomes – particularly when unlawful behaviours such as bullying, harassment, or discrimination are alleged. A well-conducted investigation ensures that both complainants and respondents can engage in a constructive and meaningful process, fostering trust and transparency.
The Power of Workplace Investigations
Workplace investigations can provide clarity on whether organisational policies and procedures have been violated. This is vital not just to uphold legal and ethical standards, but also to maintain the health and safety of the workplace. When an employee raises a concern, it is important for that organisation to take proactive steps to ensure a prompt and effective resolution.
A thorough investigation creates a foundation for psychological safety – both for the individuals involved and for the organisation. An independent, third-party investigation has a greater chance of allowing the truth to emerge through careful fact finding, analysis, and balance.
When conducted professionally, a workplace investigation can provide valuable and actionable insights. It can offer resolutions that not only address immediate concerns but also create long-term improvements in workplace culture.
The Role of an Independent Investigator
As licensed workplace investigators, we are often called in to examine complex issues, from allegations of harassment, bullying and discrimination to broader organisational audits related to psychological hazards. Our process is grounded in neutrality, with the ultimate goal of ensuring that all parties involved feel heard and respected. We draw on our experience to ensure holistic resolutions which may include workplace behaviour training from leading providers such as EEO Specialists.
In one of our recent investigations, the complainant presented allegations of bullying and its impact on their wellbeing. As we spoke to witnesses and reviewed extensive written evidence, initial patterns emerged about the respondent’s behaviour. However, as the investigation progressed and additional perspectives were considered, the narrative became more nuanced. By hearing from a wider pool of individuals and reviewing the respondent’s point of view, a fuller picture indicated that the underlying cause was poor communication rather than overt bullying.
Although there were valid concerns, our investigation provided a solid basis to identify where and when miscommunication and misunderstandings had occurred. These findings enabled us to draw unbiased conclusions and to make recommendations aimed at enhancing the respondent’s communication skills, and improving the working relationship through mediation.
This example underscores the importance of a fair and robust process. It is imperative to note possible biases in witness observations, to desist from any judgements until a wealth of evidence has been gathered, and to review each allegation discretely. Good workplace investigators walk a delicate line between incisiveness and empathy, ensuring that the process is both thorough and person-centered.
We believe that psychological safety is a key contributor to effective investigations. It helps ensure that all parties feel comfortable sharing their experiences without fear of retribution.
The Benefits of a Thorough Investigation
The benefits extend beyond just the resolution of individual cases. The process can offer organisations some vital insights into workplace dynamics and systemic issues. It can help identify areas for improvement through policy changes, leadership, training, coaching, communication, and more.
Our investigation mentioned earlier did not simply close the door on allegations – it opened a window for both parties to resolve their working relationship and to enhance their communication skills.
In the long run, effective investigations contribute to stronger, more resilient workplace cultures. They foster an environment where employees feel confident that their concerns will be taken seriously and addressed fairly. The process also minimises the risk of non-compliance with workplace behaviour legislation, costly legal actions, reputational damage, and long-term impact on employee wellbeing and productivity.
The alarming statistics from Safe Work Australia are a reminder that psychological injuries in the workplace are a growing issue that demands attention. Effective workplace investigations play an important role in addressing these challenges by providing clarity, fairness, and opportunities for improvement. By adopting a person-centered approach, organisations can ensure that their processes not only resolve individual conflicts but also support the long-term health and safety of their entire workforce.
Ultimately, the goal of a workplace investigation is not just to determine what went wrong but to identify how things can be improved moving forward.
